CANADA Patent Renewal Fee Regulations webpage?
Answer:
You must renew the patent in the second year of the patent application, regardless of whether the patent is granted or not.
The patent is then renewed each year before the “due date” (the application date).
You can renew a patent for one year at a time, or several years at a time.
Patents can be renewed up to 3 months before the due date.
The annual fee can still be legally paid within 6 months after the due date, but there will be a CAD150 surcharge fee.
If the payment is not made within 6 months after the due date, the patent will be expired.
